First such a law would have to be passed, which is increasingly unlikely as time goes on, since support for inclusive marriage laws increases with youth. I am happy with the result, but not entirely with the process. when we achieve something with the support of the majority, we call it democracy. when we achieve something without clear support, we call it a triumph of multiculturalism. The thinking is, they would rule that way, but given that they haven't ever said the current definition of marriage is unconstitutional, there would be no need to use the Notwithstanding Clause in order to take away gay marriage as of yet. Just as there was no need to use the Notwithstanding Clause to exclude gays from marrying from 1982 (the birth of the Charter) to 2005.
